Nature and circumstances of offence
- The defendant was convicted of an offence for a breach of section 17(1) of the Food Act 2003, for handling food intended for sale in a manner which will render, or is likely to render, the food unsuitable.
The defendant was convicted of the following offences for breaches of section 21(1) of the Food Act 2003, for failing to comply with Standard 3.2.2 of the Food Standards Code, namely:
- Clause 8(5), fail to display potentially hazardous food for sale under temperature control. Food found to be displayed at between 16.5 and 20°C.
- Clause 22, fail to have a temperature measuring device that is readily accessible and can accurately measure the temperature of potentially hazardous food to +/- 1°C.
- Clause 19(2), fail to maintain fixtures, fittings and equipment to a standard of cleanliness where there is no accumulation of food waste, dirt, grease, or other visible matter. The bread slicer, freezer and refrigerator seals, bench under the coffee machine, air conditioning unit, paper towel dispenser and light switches found to be unclean.
