The defendant company, in respect of section 104(2) of the Food Act 2003, Carry on a food business without a licence., namely:

1. the defendant did carry on a food business, namely a meat business involving the operation of an abattoir, for which a licence is required by the regulations, namely clause 41 of the Food Regulation 2015 that states a person must not carry on a food business unless the person holds a licence authorising the carrying on of the food business, without holding such a licence.

The defendant company was convicted for 2 separate offences under section 21(1) of the Food Act 2003, for failing to comply with the Food Standards Code, namely:

2. Food Safety Standard 3.2.2 clause 7(1) in relation to the conduct of a food business, in that it did not take all practicable measures to process only safe and suitable food as required by subclause 7(1)(a).
3. Food Safety Standard 3.2.3 clause 3 in relation to the conduct of such food business, in that it failed to comply with the requirement that the design and construction of the food premises (the abattoir) must be appropriate for the activities for which those premises were used, namely the slaughter and processing of animals.
